MakeBPM Terms of Service

Introduction

Welcome to MakeBPM.

MakeBPM is an AI music studio for creators. It helps users generate songs, beats, background music, and soundtracks. Users can then continue with available workflows such as BPM analysis, vocal removal, downloads, and publishing. As the product develops, MakeBPM may add editing, remixing, song extension, audio extraction, and related music-production workflows.

These Terms of Service explain the rules for using MakeBPM. They apply when you access the website, create an account, use free or paid credits, generate music, upload audio, process files, download outputs, or contact support. They also apply to any related MakeBPM feature.

If you use MakeBPM for a company, studio, agency, client, school, channel, podcast, game, or other organization, make sure you are allowed to do so.

Who May Use MakeBPM

MakeBPM is available to users who are at least 13 years old.

If the laws in your location require a higher age, that higher age applies. If you are under the age of majority where you live, you may use MakeBPM only with permission from a parent or guardian.

You may not use MakeBPM where the service is not allowed by law, where payments cannot be processed legally, or after your account has been suspended or closed.

Service Overview

MakeBPM may include free tools, paid tools, account features, AI generation features, audio analysis tools, and audio processing workflows.

Current and planned workflows may include AI song generation, lyrics-to-song generation, instrumental creation, vocal generation, cover generation, song extension, section replacement, remixing, and mashup creation. They may also include BPM analysis, vocal removal, stem separation, audio extraction, audio-to-MIDI, downloads, saved history, credits, subscriptions, and support.

Some features may work in the browser. For example, a BPM tool may analyze an audio file locally to estimate tempo. Other features may require uploads, server processing, third-party AI providers, third-party audio providers, storage, or payment providers.

Features may change over time. We may add, remove, pause, limit, rename, or modify features as the product develops.

Your Account

You are responsible for the activity on your account.

Keep your login details secure. Do not share your account, resell account access, create multiple accounts to abuse free credits, or use another person's account without permission.

If you believe your account has been accessed without permission, contact us as soon as possible.

Your Inputs and Uploaded Content

You may submit prompts, lyrics, style notes, moods, genres, scenes, uploaded audio, uploaded video, reference files, voice recordings, stems, demos, podcasts, project notes, and other materials.

You keep ownership of content that you upload or submit to MakeBPM.

By submitting content, you give MakeBPM permission to host, store, process, send, display, and use that content as needed to provide the service. This includes generating music, processing audio, saving history, supporting downloads, managing credits, providing support, preventing misuse, improving reliability, and operating the platform.

Only upload content you have the right to use. This includes lyrics, melodies, samples, vocals, voice recordings, stems, reference tracks, client files, copyrighted material, and third-party materials.

If your work is covered by a client agreement, label agreement, publisher agreement, NDA, platform rule, school policy, employer policy, or similar duty, check first. Make sure you may use MakeBPM for that content.

Avoid uploading private or sensitive material that is not needed for the music or audio task. This includes government IDs, financial records, passwords, access codes, medical information, private documents, and unrelated personal information.

AI Outputs, Downloads, and Commercial Use

MakeBPM may generate or process songs, beats, background music, soundtracks, vocals, instrumentals, generated cover images, previews, BPM results, and related outputs. Current and planned tools may also support separated parts, MIDI-style data, and other audio files.

Your right to use an output depends on several things. These may include your plan, whether the output was created with free or paid credits, and the feature used. They may also include the checkout terms, product page terms, rights in your inputs, and the law that applies to your use.

Paid-plan or paid-credit outputs may allow broader creator or commercial use when the plan says so. Free outputs may have different limits. The plan and product terms shown when you create or download the output control your use.

Commercial use can include monetized videos, ads, podcasts, games, livestreams, client projects, brand work, releases, distribution, sync use, paid downloads, or other revenue-generating uses.

Review outputs before you publish, distribute, sell, license, deliver them to clients, register them, upload them to music distributors, or use them in public campaigns.

MakeBPM does not guarantee that an output is unique, copyright-registerable, accepted by every platform, free from similarity claims, or free from artifacts. We also do not guarantee monetization approval or fitness for every commercial use.

Similarity, Rights, and Release Risk

AI music systems can produce outputs that sound similar to existing works or to outputs created by other users.

You are responsible for checking whether your inputs and outputs are appropriate for your intended use. This is especially important for releases, ads, client work, commercial distribution, music libraries, games, podcasts, and monetized social content.

Do not assume that a generated track is automatically exclusive, copyrightable, safe for Content ID, accepted by a distributor, or cleared for every platform. Do not assume it can be registered with a rights organization without review.

Keep records of your prompts, lyrics, uploaded files, plan status, downloads, edits, and project decisions when you use MakeBPM for serious commercial work.

Voice, Artist, Sample, and Likeness Rules

Do not upload, clone, imitate, or use a person's voice unless you have the rights and permission needed for that use.

Do not use MakeBPM to impersonate real people, mislead listeners, create fake endorsements, or create deceptive artist performances. Do not suggest that a person performed, approved, sponsored, or endorsed audio when they did not.

Do not use artist names, song titles, lyrics, recordings, samples, vocals, melodies, or style references in ways that violate rights or rules. This includes copyright, trademark, publicity, privacy, contract, platform, and music rules.

Do not use MakeBPM to create deepfake audio, political deception, scams, harassment, non-consensual voice content, or other harmful impersonation.

Content ID and Platform Claims

Do not use MakeBPM outputs to make broad or false ownership claims over material you do not control.

Do not register unmodified or lightly modified AI outputs with Content ID, rights-management systems, fingerprinting databases, music libraries, collection services, or distribution systems. This is especially important if registration may block other users. Do this only when your rights are clear and your plan or license allows it.

If you receive a copyright claim, Content ID claim, takedown, monetization block, distributor rejection, platform warning, or client dispute, you are responsible for responding to it. Contact support if you need records related to your MakeBPM task.

Credits, Subscriptions, and Payments

Some MakeBPM features require credits, a subscription, a one-time credit pack, or another paid plan.

Pricing, included credits, renewal terms, expiration rules, feature access, commercial-use rights, download rights, and plan limits may be shown in several places. Check the pricing page, checkout page, account page, product page, or feature interface.

Free signup credits, bonus credits, subscription credits, one-time credits, paid credits, and plan benefits may have different rules.

Subscription credits are tied to the billing period unless the product says otherwise. One-time credit packs do not expire unless the checkout terms say otherwise.

You authorize the payment provider to charge your selected payment method for purchases, renewals, taxes, and required fees. Payment providers may have their own terms, security practices, and refund rules.

Refunds and Failed Generations

AI generation and audio processing can create costs when a request starts.

Successful generations and completed processing jobs are generally not automatically refundable after credits are used.

If a generation fails, processing fails, a payment fails, credits are charged incorrectly, or a duplicate charge occurs, contact support. We may review what happened. When it makes sense, we may restore credits, retry processing, or help resolve the billing issue.

Refunds, cancellations, renewals, duplicate charges, failed generations, and billing changes are handled according to our Refund Policy, checkout terms, payment provider rules, and the law.

Third-Party Providers

MakeBPM may use third-party providers for hosting, databases, storage, AI music generation, lyrics tools, audio processing, vocal separation, and image generation. We may also use providers for payments, email, analytics, security, support, reliability monitoring, and abuse prevention.

When you use features that require external processing, MakeBPM may send providers the information needed to complete the request. This may include prompts, lyrics, uploaded files, reference files, generated outputs, task details, and account-related identifiers.

Third-party providers may have their own terms, data retention rules, privacy policies, and technical limits. MakeBPM is not responsible for third-party services outside our control.

Prohibited Uses

Do not misuse MakeBPM.

You may not:

• violate any law, regulation, contract, platform rule, or third-party right.
• upload content that you do not have the right to use.
• infringe copyright, trademark, privacy, publicity, voice, likeness, moral, or other rights.
• request, generate, upload, process, publish, or distribute illegal, harmful, hateful, abusive, harassing, exploitative, deceptive, or fraudulent content.
• create non-consensual voice clones, fake endorsements, deceptive performances, or impersonation.
• use MakeBPM to harass, threaten, defame, shame, exploit, or target another person.
• upload malware, attempt unauthorized access, interfere with the service, or attack our systems.
• bypass safety filters, rate limits, credits, payment systems, account rules, security controls, or usage limits.
• scrape, harvest, extract, bulk download, or use automated access except through interfaces we allow.
• reverse engineer, copy, resell, relicense, redistribute, or use MakeBPM itself as a paid product without written permission.
• use outputs or service data to build, train, benchmark, or improve a competing model or service unless we give written permission.
• misrepresent outputs as human-performed, professionally cleared, exclusive, platform-approved, or rights-cleared when that is not true.

MakeBPM may reject, block, remove, refuse, limit, suspend, or close content, tasks, downloads, features, or accounts that appear to violate these terms.

Intellectual Property

MakeBPM owns or licenses the website, software, workflows, product design, text, brand elements, service structure, and platform materials.

These terms do not transfer ownership of your uploaded content to MakeBPM.

These terms do not give you ownership of MakeBPM software, code, workflows, brand assets, datasets, models, interfaces, or platform materials.

Do not copy, resell, repackage, white-label, or use MakeBPM itself as a paid product without written permission.

Product Changes and Availability

MakeBPM is provided as an evolving online service.

We may change, pause, stop, limit, or replace features, models, pricing, credits, plans, output formats, queues, storage, downloads, or integrations.

We do not guarantee that every feature will always be available or that every generation will succeed. We also do not guarantee that every output can be recovered after deletion, expiration, account closure, provider failure, or service interruption.

Suspension and Termination

We may limit, suspend, or close access if you violate these terms or misuse the service. We may also act if you create risk for other users, create legal risk, fail to pay required fees, or abuse credits. We may also take action if you try to bypass platform rules.

You may stop using MakeBPM at any time.

Some records may be kept after account closure when needed for legal, billing, tax, security, fraud prevention, dispute resolution, backup, or operating reasons.

Disclaimers

MakeBPM is provided as an online service that may change, pause, or have errors.

We do not guarantee that outputs will be accurate, unique, original, copyright-registerable, cleared for commercial use, approved by platforms, or eligible for monetization. We also do not guarantee that outputs will be error-free, artifact-free, or suitable for every project.

We do not guarantee uninterrupted service, perfect security, unlimited availability, permanent storage, or successful processing for every request.

You are responsible for reviewing your inputs, outputs, licenses, plan rights, platform rules, client obligations, and release decisions.

Limitation of Liability

As far as the law allows, MakeBPM is not liable for indirect, special, extra, or penalty-style damages from your use of the service.

This includes damages related to generated music, uploaded audio, lyrics, voice content, client work, release decisions, distribution, monetization, and platform claims. It also includes payment issues, service interruptions, third-party providers, or account access.

Changes to These Terms

We may update these terms from time to time.

Updates will be posted on this page with a revised date.

If you continue to use MakeBPM after changes are posted, the updated terms will apply.
